Legal Notice

1. Legal Information and Acceptance

These provisions regulate the use of the Internet portal service (hereinafter, the "Portal") that Bardon y Rufo 67 SL (hereinafter, Malagacarocasion) makes available to Internet users.

Bardon y Rufo 67 SL, with registered office at Calle Tucídides, 66, 29004 Málaga and C.I.F. number B92286947, is registered in the Mercantile Registry 5 of Málaga, volume 2955, book 1868, folio 101, section 8, page MA-53558, entry 1.

Malagacarocasion holds the corresponding administrative authorization provided for in Law 16/1987, of July 30, on Land Transport and in Royal Decree 1211/1990, of September 28, (authorization number 10890813-1) which enables it to provide vehicle leasing services.

Access to the website is free of charge, except for the cost of the connection through the telecommunications network supplied by the access provider contracted by the users. Certain services are exclusive to our clients and access is restricted; specific conditions, regulations, and instructions may be established which, as the case may be, replace, complete, and/or modify this Legal Notice and must be accepted by the User before the provision of the corresponding service begins.

The services provided by Malagacarocasion will have the price indicated, where applicable, in each of the commercial offers that this entity makes available to its clients and/or potential clients. The use of these services offered to Users through the Portal is subject to specific conditions (hereinafter, the “Particular Conditions”) which, depending on the case, replace, complete, and/or modify this legal notice. Therefore, prior to the use of said services, the User must also carefully read the corresponding Particular Conditions.

The use of the Portal attributes the status of Portal user (hereinafter, the "User") and implies the acceptance of all conditions included in this Legal Notice. The provision of the Portal service has a duration limited to the time the User is connected to it or to any of the services provided through it. Therefore, the User must carefully read this Legal Notice on each occasion they intend to use the Portal, as it and its conditions of use may undergo modifications.

2. Intellectual and Industrial Property

All contents of the Portal, including but not limited to texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as its graphic design and source codes (hereinafter, the “Contents”), are the intellectual property of Malagacarocasion or third parties, and none of the exploitation rights recognized by current legislation on intellectual property may be understood as assigned to the User, except those strictly necessary for the use of the Portal.

Trademarks, trade names, or distinctive signs are the property of Malagacarocasion or third parties, and access to the Portal does not attribute any right over said trademarks, trade names, and/or distinctive signs.

3. Conditions of Use of the Portal

3.1 General

The User undertakes to make correct use of the Portal in accordance with the Law and this Legal Notice. The User shall be liable to Malagacarocasion or third parties for any damages that may be caused as a result of a breach of said obligation.

It is expressly prohibited to use the Portal for purposes harmful to the property or interests of Malagacarocasion or third parties or that in any other way overload, damage, or disable the networks, servers, and other computer equipment (hardware) or computer products and applications (software) of Malagacarocasion or third parties.

3.2 Contents

The User undertakes to use the Contents in accordance with the Law and this Legal Notice, as well as with other conditions, regulations, and instructions that may apply in accordance with the provisions of clause 1 –particular conditions–.

By way of example only, the User, in accordance with current legislation, must refrain from:

  • Reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the Contents except in cases authorized by law or expressly consented to by Malagacarocasion or by whoever holds the ownership of the exploitation rights, as the case may be.
  • Reproducing or copying for private use Contents that may be considered as Software or Databases in accordance with current legislation on intellectual property, as well as their public communication or making them available to third parties when these acts necessarily imply reproduction by the User or a third party.
  • Extracting and/or reusing all or a substantial part of the Contents making up the Portal as well as the databases that Malagacarocasion makes available to Users.
3.3 Introduction of links to the Portal

Internet users who want to introduce links from their own web pages to the Portal must comply with the conditions detailed below, and ignorance of them does not prevent responsibilities derived from the Law:

It is prohibited in all cases, unless expressly authorized by Malagacarocasion, in accordance with the applicable and current legislation at any given time, to establish iframes or frames of any type that surround the Portal or allow the visualization of the Contents through Internet addresses other than those of the Portal and, in any case, when they are viewed together with content external to the Portal in a way that: (I) produces, or may produce, error, confusion, or deception in users regarding the true origin of the service or Contents; (II) constitutes an act of unfair comparison or imitation; (III) serves to take advantage of the brand reputation and prestige of Malagacarocasion; or (IV) in any other way is prohibited by current legislation.

No false, inaccurate, or incorrect statements shall be made from the page introducing the link about Malagacarocasion, its partners, employees, clients, or the quality of the services it provides.

In no case, unless expressly authorized by Malagacarocasion, shall it be stated on the page where the link is located that Malagacarocasion has given its consent for the insertion of the link or otherwise sponsors, collaborates with, verifies, or supervises the services of the sender.

The use of any word, graphic, or mixed trademark or any other distinctive sign of Malagacarocasion within the sender's page is prohibited except in cases permitted by law or expressly authorized by Malagacarocasion and provided that, in these cases, a direct link to the Portal is allowed in the manner established in this clause.

The page establishing the link must faithfully comply with the law and may in no case provide or link to its own or third-party content that: (I) is illicit, harmful, or contrary to morality and good customs (pornographic, violent, racist, etc.); (II) induces or may induce in the User the false conception that Malagacarocasion subscribes to, endorses, adheres to, or in any way supports the ideas, statements, or expressions, lawful or unlawful, of the sender; (III) is inappropriate or not relevant to the activity of Malagacarocasion in view of the location, content, and theme of the sender's web page.

4. Exclusion of Liability

4.1 On Service Quality

Access to the Portal does not imply an obligation on the part of Malagacarocasion to control the absence of viruses, worms, or any other harmful computer elements. It is the User's responsibility, in any case, to ensure the availability of adequate tools for the detection and disinfection of harmful computer programs.

Malagacarocasion is not responsible for damages caused to the computer equipment of Users or third parties during the provision of the Portal service.

4.2 On Service Availability

Access to the Portal requires services and supplies from third parties, including transport through telecommunications networks whose reliability, quality, continuity, and operation do not correspond to Malagacarocasion. Consequently, the services provided through the Portal may be suspended, cancelled, or become inaccessible, prior to or simultaneously with the provision of the Portal service.

Malagacarocasion is not responsible for damages or losses of any kind caused to the User that result from failures or disconnections in telecommunications networks that lead to the suspension, cancellation, or interruption of the Portal service during or prior to its provision.

4.3 On Content and Services Linked through the Portal

The Portal access service includes technical linking devices, directories, and even search instruments that allow the User to access other Internet pages and portals (hereinafter, "Linked Sites"). In these cases, Malagacarocasion acts as a provider of intermediation services in accordance with Article 17 of Law 34/2002, of July 12, on Services of the Information Society and Electronic Commerce (LSSI) and will only be responsible for the content and services provided on the Linked Sites to the extent that it has effective knowledge of the illegality and has not deactivated the link with due diligence. In the event that the User considers that there is a Linked Site with illegal or inappropriate content, they may communicate this to Malagacarocasion in accordance with the procedure and effects established in clause 5, without this communication in any case implying an obligation to remove the corresponding link.

In no case should the existence of Linked Sites presuppose the existence of agreements with those responsible for or owners of them, nor the recommendation, promotion, or identification of Malagacarocasion with the statements, content, or services provided.

Malagacarocasion does not know the content and services of the Linked Sites and therefore is not responsible for damages caused by the illegality, quality, outdatedness, unavailability, error, or uselessness of the content and/or services of the Linked Sites, nor for any other damage not directly attributable to Malagacarocasion.

5. Communication of Illegal and Inappropriate Activities

In the event that the User or any other Internet user becomes aware that the Linked Sites refer to pages whose content or services are illegal, harmful, degrading, violent, or contrary to morality; or that any information included by the Users themselves through the services offered on the Portal matches the description above, you may contact info@malagacarocasion.com indicating the following points:

  • Personal data of the informant: name, address, telephone number, and email address;
  • Description of the facts that reveal the illegal or inappropriate nature of the Linked Site;
  • In the event of a violation of rights, such as intellectual and industrial property, the personal data of the holder of the infringed right when it is a person other than the informant. You must also provide the title that proves the legitimacy of the rights holder and, if applicable, that of representation to act on behalf of the holder when it is a person other than the informant;
  • Express statement that the information contained in the claim is accurate.

The receipt by Malagacarocasion of the communication provided for in this clause will not imply, according to the LSSI, effective knowledge of the activities and/or content indicated by the informant.

You must also provide the title that proves the legitimacy of the rights holder and, if applicable, the representation to act on behalf of the holder when it is a person other than the informant; Express statement that the information contained in the claim is accurate.

6. Legislation

This Legal Notice is governed in each and every one of its aspects by Spanish law.
